THESE TERMS AND CONDITIONS OF USE (THE “TERMS”) GOVERNS YOUR USE OF THE CLICKVIEW PLATFORM (“PLATFORM”). BY YOUR CONTINUED USE OF THE PLATFORM YOU AGREE TO ACCEPT THESE TERMS
What this means: These are the rules you must follow when using the Platform. By continuing to use the Platform, you are agreeing to follow them. So, it's important you read and understand them. If you don't understand them, before using ClickView speak to your teacher or parent so they can explain them to you.
Account and password rules
Keep your password for the Platform confidential and don't share it with any other person. Take all reasonable steps to stop others from using your username and password.
What this means: Keep your password secret. Don't share it with anyone, not even your friends. Do your best to stop others from using your account.
Don't let any other person log in to or use the Platform through your account.
What this means: Only you should log in to your account. Don't let anyone else use it.
You must immediately notify your employer, or someone at the educational establishment that you work for or attend (“Authorised Person”), if you think that someone else knows your password has been accessed your account.
What this means: If you think someone else knows your password, or has been using your account without permission, tell a teacher or member of staff straight away.
You must not interfere with or try to bypass the security or operation of the Platform. Don't expose the Platform to any viruses, worms or any other computer code, files or programs which might interrupt, limit or interfere with the functionality of any computer software or hardware or telecommunications equipment.
What this means: Don't try to hack or break the Platform, and don't use it to spread computer viruses or any other harmful software.
You acknowledge that the Platform and the content available (excluding the Broadcast Content if applicable, and the User Content, each as defined below) are owned by ClickView or its licensors and are confidential.
What this means: The videos and content on the Platform belong to ClickView or the people who created them. They're not yours to copy or share outside the Platform.
ClickView can monitor your use of the Platform. This monitoring will only be to make sure you're complying with these Terms or for other legitimate purposes, including compliance with ClickView's licensing agreement with applicable collecting societies.
What this means: ClickView can check how the Platform is being used. This is to make sure everyone is following the rules — it's not about spying on you personally.
If ClickView or an Authorised Person tells you to, you must immediately stop using the Platform.
What this means: If ClickView or your school tells you to stop using the platform, you must stop immediately.
User Content (things you upload)
“User Content” means anything that you upload or post to the Platform, or provide to ClickView, including comments on the Platform.
You grant to ClickView a non-exclusive, royalty-free, transferrable and worldwide right (but not an obligation) to use and reproduce your User Content on the Platform. User Content will not be used by ClickView outside of the Platform without your consent.
What this means: If you post anything on ClickView (like a comment or a file), you're giving ClickView permission to show it on the platform. ClickView won't use your content outside of ClickView without asking you first.
Where User Content includes a comment, your username may be used and published in connection with such comment on the Platform. ClickView will not be responsible for the content or accuracy of any User Content.
What this means: If you post a comment, your username will appear next to it. ClickView is not responsible for what users post - that's your responsibility.
You agree not to submit any User Content that is protected by copyright, trademark, patent, trade secret, moral right, or other intellectual property or proprietary right without the owner's permission.
What this means: Don't post anything that belongs to someone else (like music, video clips, logos, or images) unless you have their permission.
You represent and warrant that your User Content:
- does not contain or condone any of the following: sexually explicit material; violence; defamatory material; obscene, offensive, hateful or inflammatory material; discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; any unsolicited or unauthorised advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes or other forms of solicitation or advertisement commercial or otherwise;
- is not threatening, abusive or intimidating, or provided with an intent to harass, upset, alarm or embarrass any other person or cause needless anxiety;
- does not infringe anyone else's rights, including without limitation any intellectual property rights, contractual rights or any right of confidentiality or privacy; in particular, you should not submit content which includes music (unless you or the Authorised Person have written and recorded the music or have a licence from the person who wrote and recorded the music), or identifiable brands or logos, nor content which features any individual under the age of 16 without the consent of that individual's parent or guardian;
- complies with all applicable laws;
- does not misrepresent your identity or affiliation with any person, or falsely gives the impression that such content comes from someone else; and
- does not advocate, promote or assist any unlawful act (e.g. criminal acts, copyright infringement, computer misuse, etc.),
and you agree that you (or your Authorised Person) will be responsible for any loss or damage ClickView may suffer because of your breach of this warranty.
What this means: You make a promise to us to only post things you're allowed to share. Don't post anything violent, offensive, hateful, or illegal. Don't bully or threaten others. Don't use someone else's music, logos, or images without permission, and don't post videos or images of anyone under 16 without a parent or guardian's consent. Don't pretend to be someone else, and don't encourage others to break the law. If you break any of these rules and it costs ClickView money, you (or your school) may have to pay for it.
Take Down Procedure (Removing User Content)
ClickView can monitor, edit or remove any User Content. ClickView can do this if the User Content breaches these Terms, or if it thinks it is necessary to do for another reason in its discretion.
What this means: ClickView can check, change, or delete anything posted on the platform if it breaks the rules.
ClickView is not liable for any User Content available on the Platform. Where you have a good reason to believe that any User Content breaches of these Terms, is infringing your rights, or is otherwise illegal, you should notify your Authorised Person. They can then investigate it and may remove it from the Platform.
What this means: ClickView isn't responsible for what other users post. If you see something on ClickView that you think breaks the rules or is illegal, tell your school. They will try to take it down as quickly as they can or contact us if necessary.
If you want to take down any of your User Content from the Platform at any time, you should notify your Authorised Person. Tell them what the User Content you want taken down is, and where it can be found (“Notified Content”). Your Authorised Person will endeavour to respond promptly and to take down the Notified Content from the Platform.
What this means: If you want to remove something you've posted, contact you're a teacher or staff member at your school, tell them what you want removed and where to find it. They will try to take it down as quickly as they can or contact us if necessary.
Given the nature of the internet, it is possible that other users may have shared, commented on, or re-posted User Content. Whilst we will endeavour to take down any Notified Content from the Platform, ClickView gives no guarantee that the Notified Content will be taken down from other websites.
What this means: Once something is posted online, others may have already shared or copied it. ClickView will do its best to remove content when asked but can't guarantee it has been removed from other websites.
Broadcast Content
Broadcast Content may be made available to you and is subject to licences granted by the applicable collecting society to your Authorised Person and to ClickView. You must only access Broadcast Content in the manner it is made available on the Platform and you must not copy or adapt Broadcast Content for any other purpose.
What this means: Some content on ClickView may be covered by special licences. You can only watch these in the way ClickView provides them — you must not copy, download, or change them.
General
ClickView can modify these Terms from time to time. When we do, we'll give your Authorised Person notice. If you keep using the Platform after a change, you'll be taken to have accepted the updated Terms. The date at the start of these Terms shows the date they were last updated.
What this means: ClickView can update these rules at any time. Your school will be told about any changes. If you keep using the Platform after the rules change, it means you agree to the new rules. There is a date at the top of these rules that shows when they were last changed.
These Terms are governed by the laws of the state/province and country where the Authorised Person is located, and the parties submit to the exclusive jurisdiction of the courts of that state/province and country. ClickView retains the right to bring legal proceedings in any jurisdiction where ClickView believes that infringement of these Terms is taking place or originating.
What this means: These rules follow the laws of the country where your school is based. If there is a serious dispute, it would be handled in the courts of that country.
